Commonhold

Other commonhold applications

The Act provides for the following applications to be made against commonhold titles:

  • for the freehold estate to cease to be registered as the freehold estate in commonhold land during the transitional period in form CM2;
  • for the registration of an amended commonhold community statement and/or an altered memorandum and articles of association in form CM3;
  • to add land to a commonhold in form CM4;
  • for the termination of a commonhold registration in form CM5, and
  • to register a successor commonhold association in form CM6.

In addition to transactions that are exclusive to commonhold usual transactions can also affect commonhold and the normal land registration procedure applies to these applications e.g. official searches, transfers, charges.

To obtain an official copy of the commonhold community statement or the memorandum and articles of association, an application can be made in form OC2 quoting the title number of the common parts.
