Landlord's title being registered as a first registration - If the landlord's title is being registered as a first registration and the tenants lease is either examined as part of the title or the restrictive covenants are revealed on a form DI, the restrictive covenants will be noted without a separate application. Otherwise a form AN1 or UN1 must be lodged.
Landlord's title being registered as a disposition of registered land - Where the landlord's title is being registered as a disposition of registered land, a separate application in form AN1 or UN1 must be lodged.
Restrictive covenants in favour of the landlord - lease is not a prescribed clauses lease These are rare, and in nearly every case the covenants would affect land registered under a different title to that relating to the lease. For this reason an application in form AN1 or UN1 must always be lodged together with the original or a certified copy of the lease.
