    Options in favour of the landlord - lease is not a prescribed clauses lease

    First registration of the tenant's title

    Land Registry will enter notice of the burden of options in the tenant's title without a separate application where they are either:

    • listed in an index to the lease, or
    • easily identified by a side heading.

    Tenant's title is a disposition of registered land

    • If the tenant's lease was granted before 19 June 2006, the option will not be noted on the tenant's title unless a separate application in form AP1, AN1 or UN1 is made.
    • If the tenant's lease is granted on or after 19 June 2006, no separate application is required. The burden of the option will be noted when the lease is registered.

    Tenant's lease is incapable of registration

    If the tenant's lease is incapable of registration, the burden of the option must be registered as a Class C(iv) land charge.
