Overview of commonhold Amendments or additions Contents Previous Next

    Amendments or additions

Amendments to the commonhold community statement

The commonhold community statement can be amended with the agreement of all interested parties, but a new commonhold community statement must be drawn up and lodged at Land Registry as it will have no effect until it has been registered. Land Registry form CM3 must be lodged.

A certificate by the directors that the amendment satisfies the statutory requirements must also be provided.

Addition of land to the commonhold

Land can be added to the commonhold provided that the change is with the agreement of all interested parties. Likewise any change to the size of a unit must only be made with the consent of all interested parties.

In both cases a new commonhold community statement must be drawn up and two copies lodged at Land Registry. Land Registry forms CM3 and CM4 must be lodged. In the case of a change to the size of a unit, if it is subject to a charge, Land Registry form COE must also be lodged.

The next page looks at the documents that must be lodged with an application for registration of a commonhold at Land Registry.
