9 Amendments to restrictions – the effect of the Land Registration (Amendment) Rules 2005

Updates have been made to fact sheets 1,2 and 8 following the implementation of the Land Registration (Amendment) Rules 2005 and fact sheets 5 and 6 have been updated to clarify previous information. Fact sheet 9 has been produced to support these changes.

Many of you have adapted to the changes in practice brought about as a result of the enactment of the Land Registration Act 2002 on 13 October 2003 relatively easily. Despite this some customers have told us that they are still finding it difficult to adapt to certain key changes, including the practice relating to restrictions.

To help address these difficulties we have produced a series of fact sheets and annotated forms to help you better understand the effect of restrictions. You may wish to refer to these for guidance when you deal with a transaction that involves a restriction. The fact sheets and annotated forms are designed to guide you through some of the most commonly encountered situations, for example, how to apply for, or comply with, a restriction and how to get a restriction modified or withdrawn.

Our aim in producing the materials is to help increase your understanding of restrictions and in turn reduce the number of enquiries and requisitions raised. We hope that this will save time and costs both for practitioners and Land Registry. The pack is a training aid and not a detailed commentary of our practice relating to restrictions For this you should refer to Practice Guide 19 – Notices, restrictions and the protection of third party interests in the register.
